Defense Challenges Contempt Case Against Davis School Board Candidate

Davis school board candidate Beth Bourne's attorney, Jesse Franklin-Murdock, filed a demurrer Monday at her arraignment in Woodland challenging the Yolo County District Attorney's criminal contempt complaint. The case alleges Bourne twice violated a civil harassment restraining order through social media posts made on June 21, though a Sept. 15 civil-court ruling found posts from that date were not in violation. Franklin-Murdock argues the complaint is unconstitutionally vague and infringes First Amendment rights; the DA's Office has until Nov. 4 to respond, with a demurrer ruling set for Nov. 30. Bourne did not enter a plea. Separately, the Sonoma County District Attorney continues reviewing charges related to Bourne's Oct. 13 arrest for allegedly trespassing on the Sonoma Valley High School campus during a counter-protest at a student walkout over removal of a pride flag.
