San Luis Obispo County rejected a U.S. Department of Justice request to set aside ballots cast by 63 registered voters deemed "likely" noncitizens, saying there was insufficient evidence any listed names were ineligible. Clerk-recorder Elaina Cano refused the Oct. 23 demand after receiving a 48-hour ultimatum that included threats of criminal prosecution and requests for protected voter information. County counsel Jon Ansolabehere stated the registrar could not act without clear legal authority while federal courts determine the demand's legality. Meanwhile, SLO County District Attorney Dan Dow confirmed his office is investigating the 63 voters and separate referrals regarding possible unlawful voting.

On Monday, Nov. 2, San Luis Obispo County District Attorney Dan Dow filed charges of voter registration fraud, fraudulent voting, and perjury by declaration against 31-year-old John Ruel S. Ambos, alleging he registered to vote in August 2016 while not a U.S. citizen and cast a ballot in the Sept. 14, 2021 gubernatorial recall election. The charges stem from a DOJ list of 63 SLO County registrants deemed "likely noncitizens," delivered to the county Clerk-Recorder's Office on Oct. 23. Dow said his office is nearing charging decisions in 16 similar cases and that 46 other names remain under investigation. Five individuals were taken into custody Monday as part of "Operation Protect the Vote," a coordinated campaign among California-based U.S. Attorney's Offices. Dow emphasized Ambos is presumed innocent and noted some listed individuals may ultimately be confirmed eligible.

More than 20 Cal Poly students rallied Monday morning along Highland Drive in San Luis Obispo to oppose a proposal that could convert approximately 18 acres of university farmland into mixed-use development including student housing, retail, and possibly a hotel or conference center. Students voiced concerns the project would reduce hands-on learning space central to Cal Poly's "Learn by Doing" philosophy, while others acknowledged potential benefits such as additional housing. The university maintains the project would create interdisciplinary learning opportunities and replace any agricultural land used elsewhere. Cal Poly has launched a West Campus survey for students and community members to provide feedback on the proposal.
